These Terms of Service (“Terms”) govern your access to and use of the email hosting services provided by Cyniva (“Cyniva,” “we,” “us,” or “our”). By creating an account, placing an order, or using the service, you agree to these Terms. If you do not agree, do not use the service.
Cyniva provides professional email hosting on your own domain, including mailbox storage, sending and receiving over standard protocols (IMAP, SMTP, POP3), webmail access, and spam and virus filtering. The service is delivered using third-party infrastructure, and your use of the service is also subject to the acceptable use requirements of our upstream providers.
You must be at least 18 years old and able to form a binding contract to use Cyniva. You agree to provide accurate, current, and complete information when registering and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
Your use of the service must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. In particular, the service may not be used to send cold email, unsolicited bulk email, or marketing or promotional campaigns. Violations may result in immediate suspension or termination without refund, as described in the Acceptable Use Policy and in Section 6 below.
Plans are offered on a monthly or annual basis and are billed in advance through our payment processors (such as Stripe and PayPal). Unless you cancel, subscriptions renew automatically at the end of each billing period using your selected payment method.
We may change our prices from time to time. Any price change will apply to your next billing period, and we will make reasonable efforts to notify you in advance. You are responsible for any taxes associated with your use of the service, except for taxes based on our net income.
You may cancel your subscription at any time. When you cancel, your service remains active until the end of the period you have already paid for, and you will not be billed again.
Payments are non-refundable. We do not provide refunds or credits for partial billing periods, unused service, or accounts suspended or terminated for violations of these Terms or the Acceptable Use Policy.
We may suspend or terminate your account, with or without notice, if we believe you have violated these Terms or the Acceptable Use Policy, if required to protect the integrity, security, or reputation of our infrastructure, or as required by law. Accounts terminated for policy violations are not eligible for any refund. You may terminate your use of the service at any time by cancelling your subscription and discontinuing use.
We strive to provide reliable, high-availability service, but we do not guarantee that the service will be uninterrupted, error-free, or available at all times. The service is provided on a commercially reasonable-efforts basis, and scheduled maintenance, upstream provider issues, or events beyond our control may affect availability.
You retain ownership of the email content and data you store using the service. You grant us the limited rights necessary to operate, maintain, and provide the service (for example, to transmit, store, and back up your mail). You are solely responsible for the content you send and receive and for maintaining your own backups of important data.
The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements or that messages will always be delivered or received.
To the maximum extent permitted by law, Cyniva will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid to Cyniva for the service during the three (3) months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Cyniva from any claims, damages, liabilities, and expenses arising out of your use of the service, your content, or your violation of these Terms or the Acceptable Use Policy.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be communicated by reasonable means. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of [Your State], United States, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in [Your State].
